Modus consultants were involved in numerous disputes over the refurbishment of a 556 MW coal plant, including claims in excess of $50M brought by a specialty contractor against an OEM/EPC contractor and owner for extra costs, schedule delays and relief from liquidated damages. The owner brought $20M in claims against the OEM for additional costs and performance problems with the new equipment train. Both matters were resolved in mediation, with Modus consultants providing critical analysis and litigation support.
